2. Zwei Rollen — bitte zuerst lesen
OrderCEO ist eine Software für Restaurants. Deshalb gibt es zwei verschiedene Datenverhältnisse:
- Für Daten des Restaurantkunden (Konto des Betriebs, Abo, Abrechnung, Support) ist OrderCEO Verantwortlicher.
- Für Gästedaten, die im Betrieb eines Restaurants anfallen (Bestellungen, Tischsitzungen, Treuekonten) handelt OrderCEO als Auftragsbearbeiter im Auftrag des Restaurants. Verantwortlich ist dann das Restaurant, dessen QR-Code Sie gescannt haben.
3. Welche Daten bearbeitet werden
- Restaurant und Personal: Name, E-Mail-Adresse, Passwort ausschliesslich als Hash, Rolle, Betriebs-, Tisch- und Menüdaten, Gerätesynchronisation der Personal-App.
- Gäste: Bestellpositionen, Tischsitzung, Zahlungsreferenz und — nur wenn Sie ein Treuekonto eröffnen — Name, E-Mail-Adresse und Punktestand.
- Technisch: IP-Adresse, Zeitstempel und User-Agent in Serverprotokollen, zur Abwehr von Missbrauch und zur Fehlersuche. Diese Protokolle werden automatisch rotiert und nicht zu Profilen verknüpft.
4. Keine Werbung, kein Tracking
Wir setzen keine Analyse-, Werbe- oder Profiling-Dienste ein und keine Tracking-Cookies. Im Browser werden nur funktionale Werte gespeichert: das Anmeldetoken, das Tisch-Token aus dem QR-Code und die gewählte Sprache. Ohne diese Werte funktioniert die Bestellseite nicht.
5. «Mit Google anmelden»
Dieser Weg ist freiwillig. Wenn Sie ihn wählen, übermittelt Google uns Ihren Namen, Ihre E-Mail-Adresse, Ihr Profilbild und Ihre Google-Konto-Kennung — ausschliesslich, um das Konto zu eröffnen und Sie beim nächsten Besuch wiederzuerkennen. Wir erhalten keinen Zugriff auf weitere Google-Daten: keine Kontakte, kein Kalender, kein Drive, keine Mails. Dasselbe Konto können Sie stattdessen mit E-Mail und Passwort eröffnen.
6. Zahlungen
Karten- und TWINT-Zahlungen laufen über Stripe. Kartendaten erreichen unsere Server nie. Bei Gästezahlungen ist das Restaurant der Zahlungsempfänger (Stripe-Connect-Direktbelastung); OrderCEO wird nur die vereinbarte Provision zugewiesen. Rückerstattungen löst das Restaurant aus.
7. Auftragsbearbeiter
- Contabo GmbH, Deutschland — Server und Datenbank (Nutzdaten liegen in der EU)
- Cloudflare, Inc., USA — DNS, Proxy, E-Mail-Weiterleitung
- Stripe Payments Europe Ltd., Irland — Zahlungsabwicklung
- ActiveCampaign, LLC (Postmark), USA — Transaktions-E-Mail (Bestätigung, Passwort-Rücksetzung)
- Google LLC, USA — nur bei «Mit Google anmelden»
Übermittlungen in die USA stützen sich auf die Standardvertragsklauseln und die anerkannten Angemessenheitsbeschlüsse; massgebend ist Art. 16 f. DSG.
8. Aufbewahrung
Kontodaten bis zur Löschung des Kontos. Zahlungs- und Rechnungsbelege zehn Jahre nach Art. 958f OR. Serverprotokolle nur kurzfristig und mit automatischer Rotation.
9. Ihre Rechte
Sie haben das Recht auf Auskunft, Berichtigung, Löschung, Datenherausgabe und Widerspruch. Schreiben Sie an [email protected]. Als Gast wenden Sie sich bevorzugt an das Restaurant selbst — es ist die verantwortliche Stelle; erreichen Sie es nicht, leiten wir Ihre Anfrage weiter. Beschwerden richten Sie an den Eidgenössischen Datenschutz- und Öffentlichkeitsbeauftragten (EDÖB) in Bern oder, im EU/EWR-Raum, an die Aufsichtsbehörde Ihres Wohnsitzlandes.
10. Sicherheit
Alle Verbindungen sind TLS-verschlüsselt, Passwörter werden nur als Hash gespeichert, Zugriffe sind rollenbasiert getrennt und Datenbankzugänge sind nicht aus dem Internet erreichbar.
11. Änderungen
Wesentliche Änderungen kündigen wir auf dieser Seite und per E-Mail an die Restaurantkunden an.

2. Two roles — please read this first
OrderCEO is software for restaurants, so two different relationships apply:
- For restaurant customer data (business account, subscription, billing, support) OrderCEO is the controller.
- For guest data created while a restaurant operates (orders, table sessions, loyalty accounts) OrderCEO acts as a processor on behalf of that restaurant. The controller is the restaurant whose QR code you scanned.
3. What we process
- Restaurant and staff: name, e-mail address, password as a hash only, role, venue, table and menu data, device sync for the staff app.
- Guests: order lines, table session, payment reference and — only if you open a loyalty account — name, e-mail address and point balance.
- Technical: IP address, timestamp and user agent in server logs, for abuse prevention and debugging. These logs rotate automatically and are not combined into profiles.
4. No advertising, no tracking
We use no analytics, advertising or profiling services and no tracking cookies. The browser stores only functional values: the sign-in token, the table token from the QR code and the chosen language. Without them the ordering page cannot work.
5. "Sign in with Google"
This is optional. If you use it, Google sends us your name, e-mail address, profile picture and Google account identifier — solely to create the account and recognise you next time. We get no access to any other Google data: no contacts, no calendar, no Drive, no mail. You can open the same account with an e-mail address and password instead.
6. Payments
Card and TWINT payments run through Stripe. Card details never reach our servers. For guest payments the restaurant is the payee (Stripe Connect direct charge); OrderCEO only receives the agreed commission. Refunds are issued by the restaurant.
7. Processors
- Contabo GmbH, Germany — servers and database (payload data stays in the EU)
- Cloudflare, Inc., USA — DNS, proxy, e-mail forwarding
- Stripe Payments Europe Ltd., Ireland — payment processing
- ActiveCampaign, LLC (Postmark), USA — transactional e-mail (verification, password reset)
- Google LLC, USA — only for "Sign in with Google"
Transfers to the USA rely on the Standard Contractual Clauses and the recognised adequacy decisions; Art. 16 f. FADP applies.
8. Retention
Account data until the account is deleted. Payment and accounting records for ten years under Art. 958f Swiss Code of Obligations. Server logs only short-term, with automatic rotation.
9. Your rights
You may request access, correction, deletion, portability, and you may object. Write to [email protected]. As a guest, please contact the restaurant first — it is the controller; if you cannot reach it, we will forward your request. Complaints go to the Swiss Federal Data Protection and Information Commissioner (FDPIC) in Bern or, in the EU/EEA, to the supervisory authority where you live.
10. Security
All connections are TLS encrypted, passwords are stored as hashes only, access is separated by role, and database ports are not reachable from the internet.
